By using Apostille Kite you agree to these Terms of Service. Please read them carefully before creating an account or using any platform features.

1. Platform Role & Nature

Apostille Kite is a technology marketplace that connects customers who need apostille document authentication services with independent, third-party service providers. Apostille Kite does not itself issue apostilles, authenticate documents, or act as a government authority. All authentication services are performed by independent vendors listed on the platform.

2. Eligibility & Account Creation

You must be at least 18 years old to use Apostille Kite. You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the security and confidentiality of your account credentials. You may not transfer your account to another person.

3. Vendor Memberships & Billing

Service providers who register on Apostille Kite may select a paid membership tier (Bronze $5/month, Silver $10/month, or Gold $20/month). Subscriptions are billed monthly and automatically renew until cancelled. All payments are processed securely by Stripe. Refunds are handled at the discretion of Apostille Kite management on a case-by-case basis. Vendors are independent contractors and not employees, agents, or partners of Apostille Kite.

4. Communication Monitoring

All in-app communications between customers and vendors on the Apostille Kite platform are stored and may be monitored by Apostille Kite for purposes including safety, quality assurance, fraud prevention, and dispute resolution. This is standard practice on all two-sided marketplace platforms. By creating an account and using the platform, you explicitly consent to this monitoring and storage of communications.

5. Document Handling & Liability

Customers who use Apostille Kite to connect with vendors for apostille services understand that they will be required to mail or transmit original documents to the selected vendor. Apostille Kite is not responsible for lost, damaged, delayed, or rejected documents. We strongly recommend using trackable shipping methods with insurance when mailing original documents. The apostille process is subject to government processing times which are outside the control of both Apostille Kite and its vendors.

6. Limitation of Liability

Apostille Kite is not liable for errors made by third-party vendors, rejection of documents by government authorities, processing delays, or any consequential damages arising from use of the platform. Our maximum liability to any user is limited to the subscription fee paid in the calendar month in which the incident occurred. For customers using the free tier, our maximum liability is $0.

7. Prohibited Conduct

You may not use Apostille Kite to engage in fraudulent activity, misrepresent your credentials or business, spam other users, reverse engineer the platform, or attempt to circumvent the platform to conduct business off-platform with users you met through Apostille Kite.

8. Intellectual Property

The Apostille Kite brand, platform design, user interface, and all associated content are the proprietary property of Noah Greenwood. All rights reserved. The platform name "Apostille Kite" and the ๐Ÿช branding may not be used without written permission.

9. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from or relating to these terms shall be resolved exclusively in the state or federal courts located in Bexar County, Texas.

10. Changes to Terms

Apostille Kite reserves the right to modify these Terms of Service at any time. Users will be notified of material changes via email or in-app notification. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.

This Privacy Policy explains how Apostille Kite, operated by Noah Greenwood in San Antonio, Texas, collects, uses, and protects your personal information.

1. Information We Collect

We collect information you provide when creating an account, including your full name, email address, phone number, and state of residence. For vendors, we additionally collect your business name, website, primary state served, and pricing information. We also collect document information you submit (document type, issuing state, destination country), payment information processed by Stripe (we never store card numbers), and in-app communications between users.

2. How We Use Your Information

We use your information to match you with apostille service providers in your state, to process subscription payments and manage billing, to send email notifications about your requests and account, to verify vendor information and maintain platform integrity, to resolve disputes and ensure platform safety, and to improve the Apostille Kite platform.

3. Information Sharing

We share your document information and contact details with the vendor(s) you select for apostille processing. We do not sell your personal data to third parties for marketing purposes. We use the following third-party services which are bound by their own privacy policies: Supabase (database and authentication), Stripe (payment processing), Resend (email delivery), and Firebase (push notifications).

4. Communication Storage & Monitoring

All in-app messages sent between users on the Apostille Kite platform are stored in our secure database and may be reviewed by Apostille Kite staff for safety, quality assurance, and dispute resolution purposes. By using the platform you consent to this storage and potential review. This practice is disclosed in our Terms of Service and is consistent with industry standards on marketplace platforms.

5. Data Security

Your data is stored in Supabase with row-level security policies that ensure users can only access their own data. Passwords are encrypted using industry-standard bcrypt hashing. Payment card data is handled exclusively by Stripe, which is certified as a PCI-DSS Level 1 Service Provider โ€” the highest level of payment security certification. We never store raw credit card numbers or banking information on our servers.

6. Data Retention

We retain your account data for as long as your account remains active. If you request account deletion, we will remove your personal data within 30 days, except where retention is required by law or for legitimate business purposes such as fraud prevention or dispute resolution.

7. Your Rights

You have the right to access the personal data we hold about you, to request correction of inaccurate data, to request deletion of your account and associated data, and to withdraw consent for marketing communications. To exercise any of these rights, email [email protected].

8. Cookies

Apostille Kite uses minimal cookies necessary for session management and authentication. We do not use third-party advertising cookies or tracking cookies.

9. Children's Privacy

Apostille Kite is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children.

We may update this Privacy Policy periodically. We will notify you of significant changes via email or in-app notification.
